1. Seller. The Words4.me service is provided by Brava Capital BV (the "Seller"), a company incorporated in the Netherlands. By continuing to use the service you agree to these Terms.
2. Acceptance. Your continued use of Words4.me constitutes acceptance of these Terms and the Privacy Notice. You confirm that you are of legal age in your jurisdiction or that you have permission from a parent or legal guardian.
3. The Service. Words4.me is a language-learning application that helps users build active vocabulary through spaced-repetition training, translation, pronunciation practice and AI-assisted exercises.
4. Account and accuracy. You are responsible for keeping your account credentials confidential and for providing accurate information. You may not share your account with others.
5. Acceptable use. You will not (a) use the service unlawfully, (b) attempt to disrupt or reverse-engineer the service, (c) scrape or bulk-download data, (d) upload malware, or (e) infringe intellectual property rights of the Seller or third parties.
6. Intellectual property. All software, content, branding and materials of Words4.me are owned by the Seller. You receive a limited, non-exclusive, non-transferable right to use the service within your chosen plan.
7. Payment and subscriptions. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to billing, and handles returns. For all payment, billing, tax, cancellation and refund mechanics please refer to Paddle's Buyer Terms.
8. Service level. The service is provided "as is". We do not guarantee uninterrupted or error-free performance and disclaim all implied warranties to the fullest extent permitted by law.
9. AI features — acceptable use. Words4.me includes AI-assisted features (translation, sentence generation, vocabulary enrichment, the "Mia" assistant). You will not use these features to generate or attempt to generate (a) illegal content, (b) content that infringes third-party rights, (c) hate speech, harassment, sexual content involving minors, or violent extremism, (d) deepfakes or impersonation content, (e) malware or code intended to compromise systems, or (f) content intended to circumvent the AI's safety mechanisms ("jailbreaking"). You are solely responsible for the prompts you submit, the way you use AI outputs, verifying their accuracy, and ensuring you have the rights to any content you input.
10. AI accuracy disclosure. AI-generated outputs (translations, example sentences, explanations) may be inaccurate, incomplete, or reflect biases present in training data. They are provided for language-learning purposes only and must not be relied upon as professional linguistic, legal, medical, financial, or any other regulated advice without independent verification.
11. Content moderation. The Seller reserves the right, but has no obligation, to filter, restrict or refuse AI outputs, remove user-submitted content, and suspend or terminate accounts that violate Section 9. Rights-holders who believe content infringes their intellectual property may submit a takedown request to support@words4.me; repeated infringers will have their accounts terminated.
12. Suspension and termination. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination your access ends; you may request an export of your personal data within 30 days.
13. Liability. To the fullest extent permitted by law, our aggregate liability for any claims arising from your use of the service is limited to the fees you paid in the 12 months preceding the claim. We exclude liability for indirect or consequential damages. Nothing in these Terms excludes liability for fraud, death or personal injury where prohibited by law.
14. User indemnity. You will indemnify the Seller against claims arising from your unlawful use of the service or from content you submit.
15. Governing law. These Terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the competent Dutch courts.
16. Force majeure. Neither party is liable for failure to perform due to events beyond reasonable control.
